Mentor6 months agoI think you mean 5th Feb.
However how can seller relist something in your possession, unless he has more than one.
It is up to you to escalate, ebay does not act unless to escalate, they would just assume that you and seller had resolved the problem and case closes.

Is it fraudulent to offer for sale goods that he has not refunded?
Are the goods technically still mine?
They are of no use to me as the parts are too badly worn according to my mechanic, so I don't want them back. I just want my money.
He does not have two, the pictures are exactly the same as the original.
He has my £400 and the goods.
Help please+

·6 months agoIf you sent the item back on 30th December, you are out of time to get any help from Ebay.
You will have to sort this out with the seller.
If you had given more information at the start, you would have been told that straight away.
You have 30 days from receipt to open a case through Ebay.
You say you 'opened a refund with Ebay' on 7th January, several days after you had sent the item back and a week after the seller received it.
If that was a return case, and you added the tracking, you then had 21 days to go back to the case and ask Ebay to step in.
If you did start a return/open a case then using the proper Ebay procedure (and I am not sure that you did), the case would be closed by Ebay 21 days after it was opened if you didn't ask them to step in.
As it was an expensive item, you should see if your payment provider can help you to get your money back.
I think you need to get legal advice for these two questions.

Mentor6 months agoIf you have opened a case for a refund on the 7th of January hurry and escalate it, ask eBay to step in, because with no action the case will close, and you cannot open another with eBay, for that item.
If you are out of time to escalate and the case has closed, you'll need to turn to your payment provider now, for help with your refund.

Are you still in time? What was the item's last estimated sate for delivery ? You have to be within 30 days from that date to open any case for a refund, are you still in time ?
Secondly, why do you wish to open a case? Is it for an item not received, or you have received one and it's damaged / not as described?

Mentor6 months agoYou have received an item not as described, go right of the item in your Purchase History and from More Actions select... Return this item selecting the reason Item Does Not Match Description or Photos.
The seller needs to accept this case within 3 days and refund, if they want their item back first , they need to pay for that fully tracked return postage, then on receipt of their item they have 48 hours to refund you. If they don't , need to escalate the case, ask eBay to step in, and they'll force the refund.
Never listen to any excuse or promise from the seller to close the case early, and do not forget to escalate.

Have you still got it?
If so, as advised, you need to open a return.
The seller seems to have relisted it really quickly - I can't understand why they would do that if you received the item and still had it.
Apologies for all the questions, but more information usually leads to better, more accurate advice.

Mentor6 months agoI can't quite follow what you have done, have you opened a case using the money back guarantee?
If so is it a return case or a case for item not received?
Cases close if no action is taken and you have limited time to open one.
