Prove item is real or prove it is fake?

I have purchased a used item from a seller and I had concerns as soon as I opened the package that the item was fake. The item in question has a serial number that can be used to check with the original manufacturer, which I have done, and the item I have bought does not correspond with the registered item. Regardless of this, the item is extremely poor quality and I have compared to genuine items I already own and it is clear it is not genuine. I contacted the seller with my concerns along with photos comparing the item and also a copy of the serial details checked with the manufacturer showing the item does not match but the seller is refusing to accept it. He claims I have to prove, in writing from the manufacturer, that the item is fake, yet he cannot provide evidence the item is real. He claims the item he sold was bought from eBay so it is eBays fault if it is fake and is refusing to accept a return.
Should I have to prove that the item is fake or should he have to prove it is real, considering I have already provided evidence? The seller is threatening legal action against me for defamation because I believe that the item is not genuine.

You don't have to prove that it's fake - eBay almost always takes the buyer's word against the seller's.
What you can do now depends upon how long ago it was delivered. If within 30 days, you can use eBay's money back guarantee. After 30 days eBay will have no interest, and you may need to ask your payment provider whether they can help. Unlike eBay, they may require documentary evidence that the item is fake.

Mentor1 month agoYou have 30 days to open an eBay return ands select the 'doesn't match description or photo' reason. State in the return that the serial details don't match the manufacturers etc.
After 3 business days if the seller doesn't issue you with a pre-paid returns label then use the option to ask eBay to step in.

Mentor1 month agoAll you had to do was use the money back guarantee and open a return for item not as described. If you are within 30 days of delivery you can still do that.
