Bought a transmission jack and when it was delivered the box was ripped, so not sure whos to blame,

Use the reason "Item damaged" and if necessary escalate it to eBay after 3 complete working days.
If it's a private seller ebay will refund for items damaged by courier in transit and the seller keeps the payment.
