This is my message to Ebay
Dear eBay Customer Services,
I am writing to formally escalate my complaint regarding a transaction that eBay has thus far refused to cancel or refund, despite clear evidence that the seller could not fulfil the order.
Following my purchase, the seller informed me that the item had allegedly been removed from sale approximately one week prior to my purchase and therefore should never have been available to buy. If this statement is accurate, then the listing was invalid at the point payment was taken from my account.
Despite this, eBay has declined to intervene appropriately or provide a satisfactory resolution under the eBay Money Back Guarantee.
I find this position entirely unacceptable.
The core issue is straightforward:
- Payment was taken for goods that the seller states were unavailable before the transaction occurred.
- The seller has confirmed they cannot fulfil the contract.
- I, as the buyer, have received neither the item nor a refund.
- eBay continues to retain or process payment despite the transaction being fundamentally defective.
Under these circumstances, it appears eBay is attempting to avoid its obligations under the Money Back Guarantee by refusing to properly acknowledge that the transaction could never have been completed.
As the platform facilitating the transaction and processing payment, eBay has responsibilities to buyers when goods are unavailable or a seller cannot honour a sale. The current handling of this matter falls well below the standards I would expect from a marketplace of eBay’s size and reputation.
I now require the following:
1. Immediate cancellation of the transaction.
2. Full reimbursement to the original payment method without further delay.
3. Written confirmation explaining why the Money Back Guarantee has not yet been properly applied in this case.
If this matter is not resolved promptly, I will pursue the issue further through:
- A formal chargeback claim with my credit card provider;
- A complaint to the relevant consumer protection authorities; and
- Any further remedies available under UK consumer law.
I would strongly prefer to resolve this directly with eBay, but I require meaningful action rather than further deflection of responsibility between eBay and the seller.

Mentor2 months agoBuyers have 30 days from the latest estimated delivery date showing on their order to open an eBay item not received claim and get a full refund. Did you wait too long?
Buyers have 180 days to open a claim with PayPal if they paid that route.
If paid with a debit/credit card or Apple Pay buyers have 120 days to issue a not as described chargeback.

Mentor2 months agoInstead of all that, you should have opened a Not received case within the 30 days allowed and seller could have refunded.
Seller was avoiding refunding or cancelling using reason “Out of stock” as he would have got a defect, which can be very damaging, especially for low volume sellers. zonce you asked he u ould have cancelled the sale using reason “Buyer’s Request”.
All so simple.
