Opened a case and wanting a refund

Accidentally purchased an item and immediately requested to cancel it after being told to purchase first.

Finally agreed with seller to get my money back but because there’s an open case he can’t refund.

EBay were in agreement with seller because he told them he’d packaged the item and was ready for dispatching.

I can’t get to access anything or anyone to remove the issue.

What kind of 'open case' is open?

If your seller downloaded the postage label then the order would be marked as dispatched (even if it hasn't actually gone out yet) and it wouldn't be possible for them to cancel at that stage.

Wait for the estimated delivery date to pass then open a "not received" case.
