My photos used by another seller

Hi All,
I discovered by accident another seller in America using my photos. My pics were of a brand new item & they are using them to sell a used version of the same item.
I reported it as I was interested to see what Ebay's response was & obviously because I've put the time & energy into putting the pics together. The response came back from an automated system and did not uphold that there was a problem.
Just seeing from all of you in the community whether this is right, it seems unfair that others can do this?

MentorJul 19, 2026 at 8:31 AMWhen you read the T & C's of Ebay, which very few do, when you upload pictures you waive your rights to them being yours and other sellers are free to use.
However they do potentially leave themselves open to item not as described cases etc.

That's fair enough if it's in the Ts & Cs.
I'll have to just get more creative & see if I can lay an image "over" the picture. Not sure how yet, lol, but I've seen other pictures with logos on so I will look into.

If the photo has just been snagged for the one sale I wouldn't worry about it, plus its a daft seller who does that to list a used item with a photo of a new one, buyer expectation is going to take a dive there!
