Item not as described but can't return
Hi,
I ordered a puzzle, but it arriving smelling strongly of damp. Because my mum is immunosuppressed, I had to immediately bin the item. I tried talking to the seller, but they were uncooperative. Is it possible I can still get a refund? I can't return the item because it wasn't safe to keep around.

Mentor10 months agoin the negative feedback you left you stated the seller wanted the item back if you wanted a refund.
that's quite reasonable as you could have sealed the puzzle in a plastic bag.

Mentor10 months agoIt would be very unusual, in fact unheard of for a seller to refund without having the item back, or at least seeing it if there was an issue. Obviously if you've binned it you can't return it and give the seller a chance to put things right.
I'm not sure why you left feedback saying the seller would only refund if you returned the puzzle when this is the only option according to the ebay money back guarantee.

OP10 months agoIt shouldn't have been sold in that condition in the first place, or at the very least the seller should have at made it clear in the description. If the seller knew the item was mouldy, then it is wrong of them to not issue a refund - regardless of Ebay's rules and whether or not I return the item.

Mentor10 months agoEbay have rules for returns and they have to be followed by both buyer and seller.
By not following the rules you let seller off the hook, as not only could you have got a full refund seller would have had to pay for return postage label.
Leaving seller very much out of pocket should teach them a lesson, instead you have just let him off with no penalty.

Mentor10 months agoSorry, rules are, you need to return an item which is faulty / not as described to receive a full refund.
Have you messaged the seller explaining the problem? They may ask you to open a case and they'll refund without the need to return the item.
Nothing to enforce them to refund, but worth asking if they would do this for you.
