Item left outside property ‘delivered’ has since been stolen and eBay seller is refusing refund

Item dumped outside my house ( photo shows item shoved in my door wreath) and was stolen. EBay seller has said it was delivered and therefore will not refund me and eBay have closed the case.
Under the Consumer Rights Act 2015, the retailer is legally responsible for your goods until they are in your physical possession. If a courier leaves a package outside or on a doorstep without your prior consent and it is stolen, the delivery is incomplete, and the retailer must refund you or send a replacement.
Anyone had this issue before ? I’m so angry that I have no item and no refund, I was only £10 but the principle remains the same surely ?

Mentor3 weeks agoYou're correct there if your seller is a UK registered business seller, but would need to enforce that yourself.
You should be able to appeal the closed case, if it's not found in your favour and you funded your payment with a debit/credit card or Apple Pay then you can issue a not received chargeback via your payment provider.

Mentor3 weeks agoEbay's money back guarantee uses rules that make things simple. They therefore rely on tracking.
If you bought from a business seller you need to persue your statutory rights with them.
