It's unwise to be so specific in your question. Discovering that an item is counterfeit is only one of the risks.
If you're relying on eBay's money back guarantee to protect you, start by reading it: https://pages.ebay.co.uk/ebay-money-back-guarantee/
Be sure to pay by a method that qualifies for buyer protection. Understand the time limit to open a case (30 days from delivery). Be aware that from day 31 eBay won't be interested, whatever happens.
For counterfeits, you can at least take steps to have the phone authenticated. A bigger risk is that it will be reported stolen, and blocked. We regularly hear from buyers who only discover more than 30 days after delivery that their phone is stolen. So no protection from eBay.
You may still be protected by your payment provider. The best extra protection is to pay eBay by credit card. That way, not only could you ask them to issue a chargeback, but if the phone cost more than £100 you will also be covered by statutory credit card protection under the consumer protection act.
It makes sense to at least minimise the risks of buyng from strangers here by knowing how you're protected, familiarising yourself with the terms and conditions and where possible paying in a way that provides additional protection.
Never forget that eBay warns buyers in the user agreement (section 2) that they do not guarantee the quality of items, that descriptions will be truthful or that items will be safe, legal - or even exist. Would you buy a phone from a shop that said this?? If something goes wrong, it was your choice to accept these risks. eBay is a jungle.

Mentor10 months agoYes. It won't matter what it says on the listing if they call it an iPhone and it's not you are entitled to a full refund. You would open a "not as described" return and escalate after 3 complete working days.
