I want my money refunded

I purchased a tshirt 25.05.26 and waited for it to arrive. It was showing as dispatched but waiting for tracking. I waited and waited, then went on holiday, expecting it would have arrived by the time we came back. It had not, and then when I went to report it, it told me the 30 day window was closed.
These seller had lied about sending it, and after 30 days, that's it apparently. They get to keep your money and it's tough luck on you.
I then tried to report the seller, but it won't let me, it just keeps taking me in a loop. I can't review the seller, because the product is not showing as delivered.
Having checked reviews for this seller, they are doing the same to lots of people, and then just keep the cash.
How is this legal?
How is it that I can purchase something, and if the seller decides to rip people off, ebay lets them keep selling?

It may not be. eBay warns buyers that they don't guarantee that sellers' claims will be truthful, or even legal. You accepted this risk in the user agreement. eBay is a jungle.

eBay also makes it clear that it's own money back guarantee only lasts for 30 days. It's risky to buy things here if you will be away when this time limit expires. Depending upon how you paid, you best hope now is that your payment provider may still be able to help.

You don't "report" sellers on eBay, you need to use the procedures that eBay provides to notify them that you did not receive an item. This engages eBay's own systems to monitor seller's performance, as well as refunding you. It's too late to do this now. Try speaking to eBay if you wish, but I'm afraid it will be pointless - even if you manage to get through.
The question you should have asked is how to protect yourself from this happening again. The sad thing is that eBay's money back guarantee generally provides genuinely strong protection, if only buyers read the conditions and time limits. There is a link to it in every listing. Buying here without knowing how you're protected is like dangling your feet in a crocodile swamp.

Now you contact your payment provider for assistance, they usually allow 120 days.
