Faulty Goods
Summary: robsnail bought a faulty item in February and despite multiple promises from the seller, a replacement has not been received by July. The seller has been polite and has claimed to send several replacements, but none have arrived, and robsnail is skeptical of their claims. Since the issue was raised after eBay's 30-day limit, they've sought advice. *vyolla* suggested considering legal advice or a chargeback if paid by card, but options are limited due to the time elapsed. robsnail is frustrated as the seller continues to trade, seemingly exploiting the system's limits.
I bought an item in February. It was found to be faulty and the seller was informed. A replacement was promised. It is now July and the replacement has not yet appeared. The seller has been apologetic and polite and has apparently sent four replacements to date, none of which has ever arrived. When contacted the seller asks for yet another week to see if it arrives. I question if any has ever been sent in the first place.
As it is now way beyond the 30 day notice I cannot ask eBay to help.
I trusted the seller to do the right thing but now realise I am being strung along.
Meantime I have a faulty item for which I have been promised a replacement and no way of persuading the seller to comply.
The trader is still trading on eBay.
Where do I go now?

Mentor3 weeks agoAs you've discovered, you have 30 days to return an item that's not as described via eBay, same for PayPal.
If you paid with a debit/credit card or ApplePay you have 120 days to issue a not as described chargeback.
Unfortunately, for items bought that long ago, you're way out of time to pursue a refund.
If your seller is a UK registered business seller you may want to take some free advice from one of the online consumer groups or Citizens Advice regarding pursuing this via a legal claim.

OP3 weeks agoThank you for your response.
I should add that the seller was informed within two days of my receiving the faulty goods ( well within the 30 day limit ) and they acknowledged the problem. They have strung me along ever since. I suspect it was to get past the 30 day limit that they have done this. I have had messages from them almost every two weeks apologising and saying they will send another replacement.
What is galling is that they are still trading on eBay knowing that neither eBay nor I can touch them.

Mentor3 weeks agoUnfortunately some sellers will do this, they know how to play the game. It's vital to keep an eye on the calendar. It's also a shame that you're past the 120 days chargeback timeframe too.
