Fake item sent, seller won't refund

A company in Leichenstein sold me a used phone as brandnew. Thankfully, I didn't open the packaging it came with because they sent the wrong phone so there was no point. The seller has now withheld 50% of my money saying there were signs of hard use-use-scratches and scuffs. I have raised this as a case as this is clearly fraudulent. Is there anything else I can do? Can I still get my money back? It's a scary situation.

Mentor1 month agoHas the case closed with a 50% of the money already given to you? If so, and you are entitled to a full refund if you've claimed within 30 days of the item's last estimated date for delivery, then contact Customer Services .
Contacting eBay Customer Services is not easy nowadays to get a live agent , but some have had success using the app, otherwise keep typing in ' I wish to speak to an agent' and this too can work.
