I suggest you do, its on every listing. If the item has been received within the last 30 days of the last date from estimated delivery then you need to open an item not as described. Do not take excuses from the seller, the whole process is automated by eBay, if you follow you will receive your money back once the item has been returned.
Secondly if you are outside your 30 day period to claim via eBay then you may get recourse with your payment provider. (You have up to 120 days with the banks)
