Ebay cancelled my listing - said it was 'counterfeit'

I listed a brand new Dyson Airwrap, an old item which had been left in a wardrobe and never opened, and within two days Ebay stopped my listing and said it was counterfeit. I have over 6,700 feedbacks on Ebay and have been selling and buying for over twenty years. I appealed their decision - which they stated was made by an automated system, i.e. AI, and they just told me that I 'lost the appeal' or words to that effect. I haven't sold the item, nobody can know whether it's real or not, in order to complain about it, so why have they done this? I have another few Dyson items which have sold, which are also new but old items, also left in the same wardrobe under a pile of clothes by a friend's deceased relative. What is the reasoning behind something being declared 'counterfeit' by Ebay, and what purpose does this serve, if there is no way to talk to a human being about it?

Doesn't apply to me. "buy goods for resale". Where would I buy a Dyson HD01, to resell, ten years later, or however long it has been out? Lots of my items are older than two or three years, and no longer made - I know, because I've had difficulty finding others of the same item on Ebay, to see what price to sell them at.
Anyway, I will be selling the Dyson things on Gumtree.

Mentor3 months agoIt's not us that you need to prove you are not a business.
AI picks it up, no human ever checks your items.
However, Ebay have to report accounts that sell over £1000 (not sure exact figure) to HMRC.

Mentor3 months agoEbay reports sales to HMRC that exceed €2,000 (approx £1,750) in a calender year, or 30 sales in that year, whichever is reached first.

OP3 months agojck1957, the owner of the items is deceased. Her parents are in their 80s and my wife and I are helping clear her flat, her parents don't understand computers. I don't think I'm going to hit a threshold, the total value of the items is only about £2,000 - £3,000?
It would be impossible for me to help her parents run the account, they live 30 miles away and we would have constant queries about this and that, it's much easier if I do it all for them, as I have 20 years of experience on Ebay. I'm not worried about the HMRC querying my sales, I still have to sell all this stuff for my friends, or it will all go to a house clearance company for nothing.
And I to have to convince people reading this thread that I am not a business seller, because it's relevant to them and how they might reply.
I can see that the AI is rubbish, is over zealous, and should have a human being checking each time the AI claims something is counterfeit with no evidence. Why would anybody counterfeit a Dyson HD01, which is ancient, when presumably most people want to buy the latest Dyson model, which is HD08 or something like that?
Anyway, I will find somewhere else to sell them, or possibly give the two Dyson items to friends as a (very generous) present, and pay the friends I am selling them for, what they would have got on Ebay. But this is just another example of the ridiculous idiocy of people who think that 'AI' is actually 'intelligent', it isn't. It can't think, it can't reason, and it shouldn't be making decisions like this. (Final decisions, I mean - it's fine for looking for POTENTIAL counterfeit items and then telling a human about them.)

Mentor3 months agoFor some reason, all items removed at the request of the Brand Owner, the standard advice refers to fakes. It is not the fault of AI in this situation, ebay could send a better advice when removing items because of VERO.

OP3 months agoThanks for your replies. I'm not a business seller, I am selling items from the estate of a friend's deceased relative, because they are very old and can't use Ebay. The items are mainly new (but all are at least two years old, some are more than five years old) because their relative used to buy a lot of things online and was a bit of a 'hoarder'. There are plenty of used items which I will be listing today and tomorrow, I just listed the new ones first, as they were worth the most.
I have now had a Dyson hairdryer removed because it's 'counterfeit', I am not going to appeal because it's pointless, it's obviously not read by a human being. This is a most bizarre policy to introduce - letting 'AI' decide what is counterfeit and then not even getting humans to check any of it. And making it impossible to talk to a human being. I've been on Ebay for over 20 years, that's why I have such high feedback.

·3 months agoYou don't have to convince other members of the forum that you are a private seller.
However, all of the proceeds from your sales will go into a bank account (presumably yours) with the same name as your Ebay account, and it is possible that HMRC may query your sales, profits and tax liability when Ebay send them your details after you hit one of the annual thresholds. So, make sure you have all the paperwork in place to show these were inherited items and the funds went to a third party.
Equally, it is not unknown for Ebay to ask sellers who sell large numbers of brand new items for receipts to confirm ownership.
Would it not be possible for the owner of these items to have their own Ebay account, with payments going directly to them?
You could of course help them to run the account.

You can change your private account which is only for selling used unwanted items such as a garage/ wardrobe / attic clear out , to a Business account so you can sell all Brand New items here:
Probably best to use a PC / laptop for this, and not the app or mobile browser. Chrome seems to work best on eBay.

Read VeRo at bottom of page, brand owners may have reported you.
Do not relist removed item.
