Buyer Protection Question

I have an order that had a "Hand over to airline failed" from 4PX china because the seller did not have the item down as it having magnetic parts for the LED lights inside. Two days later the tracking changed to "In transit,it's progressing through delivery network" where it has never updated since in 22 days (been in transit for a total of 30 days). I contacted the seller whos reply did not make too much sense, probably lost in translation but in short assures me its still on the way. However there is just 10 days left of the delivery window and i am pretty sure i am not going to receive it. If i open a item not received after the delivery window (obviously assuming it does not turn up in the mean time) and the seller offers to send another one, does the buyer protection still expire at the end of the 30 days from the original delivery date? Or does it start from the estimated delivery of the replacement? Hope that makes sense. Thanks for any advice.

Mentor1 week agoeBay item not received claims must be made within 30 days of the latest delivery date showing on your order.
I wouldn't ask for a replacement else you may be dragged past the time you have to apply for a refund. Get a refund and then repurchase.

OP1 week agoOk, thank you. I know that it is unlikely a replacement would go missing too, but in light of this i would probably be better off asking for a refund and buying it elsewhere, because if the delivery time goes past that 30 days i would not be covered.
