Buyer Guarantee Does NOT Work
The seller did not want his useless item back, promised me a refund which has not arrived.
The criteria of this situation does not match anything Ebay offers, so no help what so ever and the guarantee is NOT a guarantee in law unless it is independent of Ebay rules
How can I opt out of paying this scam Ebay premium on top of buyers price

Mentor4 days agoeBay's money back guarantee forms part of the terms and conditions for buying and selling here. You accepted the conditions in the user agreement, including the 30 day time limit, and also to accept their decisions.
It's completely separate from and in addition to any statutory consumer projection you may have. That said, in most situations it's still usually the best protection for buyers here - provided they follow the conditions carefully. Statutory consumer protection is only as good as your ability to enforce it, and of course many sellers are registered in other countries anyway.
If you have missed the 30 day time limit, try your payment provider e.g credit or debit card issuer. Their time limit will be longer, probably 120 days.

Mentor4 days agoThe buyer protection fee has nothing to do with the money back guarantee which is what protects buyers from not receiving goods or receiving goods that were not as advertised.

Mentor4 days agoBuyers can promise anything but it cannot be enforced just ignored and to carry on with your opened case, and escalating on day 4.
The exact reason for returning a ' useless' item may not be there, but item does not match description covers most reasons for returning a misdescribed / faulty item.
For any future instances where you need to return anything as above, use that reason, do not listen to the seller, just escalate on day 4, eBay step in and force the refund.

Mentor4 days ago · EditedWithout having some more details its difficult to advise, but it's pretty difficult for a buyer to lose out on eBay.
You have 30 days to return an item that's not as described via eBay’s Money Back Guarantee/Buyer Protection, same for PayPal.
If you paid with a debit/credit card or ApplePay you have 120 days to issue a not as described chargeback.
