i bought a set of vw seats ,and paid for the item with buy it now, i messaged the seller asking them where was the collection point, and the seller has ignored 5 messages, i contacted ebay asking for a refund they said wait 3 days for the seller to reply he hasnt ebay said they would intervene , and now got a email saying its over 3 days so they have cancelled the refund so now no further forward

You will be able to open an 'item not received' case even though this was a collection only item.

So, a week after you made the purchase, use the Ebay Money Back Guarantee and start a case.
