Why have I not got a choice to give my national insurance no. if I didn't there could be issues selling.its my own stuff and not a business ,is this a privacy issue. so basically If you dont give it you can't sell

That is correct, once you hit the levels of selling 30 items a year or I think it's still £1700, your NI number eBay require to pass onto HMRC, who may or may not check what you are selling, and decide if tax to pay is applicable.

If you are asked for your number and do not provide it, you will not be able to sell on eBay.
