Asked seller cancel my offer as Phone was described as New but saw a scratch on screen

I messaged seller three times. They did not return any of my messages. they accepted my offer. I contacted eBay and they had provided a tracking number however it is still not with Royal mail. eBay did a cancellation request which has been denied. Where do I stand on this?
