14 day 2013 rule
Buyer waits nearly 4 weeks to ask for a return. Buyer also did not understand what he was buying as evdidenced by his replies to my comments and questions. Ebay are going to charge me for the return. Do I take Ebay Commerce Ltd or the buyer to court for my loss?

Mentor2 months agoIf a case was opened within the time limit and eBay has found in the buyer's favour it's hard to see how you could take either of them to court. In the user agreement both you and the buyer agreed that eBay would decide all disputes, and that you would accept their decision.
If eBay has initiqlly found against you your best hope is to appeal their decision and explain why you believe the buyer's case was unjustified. But at the end of the day, when you buy or sell on eBay you have to accept that it's their site, their rules, their decisions. Unfortunately eBay's money back guarantee is not regulated by the financial conduct authority, so there is no right to any independent appeal against their decisions.

I can only think you are prepared to spend money on court fees, and still not recover anything.

You issue returns label & only refund on return.
If you don't want item back, refund through case without return.
You are selling a lot of new items, so ebay may consider you a business.

I doubt you will get anywhere taking buyer or ebay to court, as you agreed ebay T&C's when opening account.
