Seller Threatens Legal Action Over Simple Return Case
Summary: ounz experienced issues with a seller after receiving a damaged DVD from a purchase. I purchased an item from a seller it was a box set dvd.
One disc had a crack in it so I opened a returns case. There really was nothing else to it, nothing else was said by me.
The seller replied stating the image i took was downloaded from the internet because its a png (what???) that im trying to get a refund for nothing and then said and I quote:
"I would close your request now if I were you, unless you want me to pursue this legally."
This is threatening behaviour, blackmail.
Reported to ebay and they replied stating there is nothing wrong with the sellers message i quote:
"We looked into your report and didn’t find the content to be in violation of our policy."
What the hell is this farce.

OP2 weeks agoThx all for your help. What bothers me more is sellers are allowed to threaten legal action to scare buyer into closing case and ebay allows this

·2 weeks agoIt's not allowed, but has to be reported, because eBay cannot possibly vet and monitor the hundreds of thousands, perhaps millions of message passing between members.
Report that message.

·2 weeks agoI wouldn't lose any sleep over it. Sounds like a keyboard warrior with a god complex going on. Just make sure you photograph (or better yet film) you wrapping up the return and send it back. If the goods are damaged or not as described, he doesn't have a leg to stand on.

·2 weeks agoThere is really no need to take photos or film wrapping up the return as they won't prove anything and eBay won't look at them.

It is obviously just an idle threat from the Seller, as there is no way that they would win any legal case, so just proceed with the return request through eBay and don't communicate any further with the Seller.

Just proceed this way:
If you are still within 30 days of the item's last estimated date for delivery, go right of the item in your Purchase History and from More Actions select Return this item. Select the reason Item Not as Described >> Does Not Match Description or Photos.
The seller needs to either refund you in 3 days, or issue a pre paid return label for the return of their item. Once the item is received, they have 48 hours to refund you.
If this doesn't happen, you need to escalate to eBay, eBay step in and force the refund.
Listen to no excuses or promises from the seller to close the case early, and do not forget to escalate.
