Returned AirPods due to not as described, seller opened case for them being opened? | Buying

Hi all, I purchased some AirPod Pro 2’s off of a business on eBay. They arrived and I opened them and found the firmware wasn’t updating and the case wouldn’t reset which made me believe they weren’t authentic, the warranty expired in 2024 when under the listing it said “1 year manufacturers warranty” as well as a weird feedback noise from one of the earbuds. Plus the model number on the AirPods themselves didn’t match, and was the same as the case which indicates they’re not fully real. And the serial number wasn’t the one in the eBay listing picture. I sent them back under the reason item not as described and listed this along with screenshots. The seller has opened a case to eBay saying they sent them sealed and returned used and opened, they can’t give me a refund. eBay has now contacted me saying they’ve placed the case on hold to allow time to review additional documentation. I’m a bit worried, if I hadn’t had opened them I wouldn’t have known they had the issues they did. Will eBay see my argument as valid?
