Sellers Guarantee

Hi can anyone inform me about this subject,

if a seller offers a five year guarantee with a purchased item, then wont answer your messages when you contact them, what can be done.

Also why is a chatbot making decisions on who should talk to a human, automated decisions are not legal under the DPA 2018 incorporating the GDPR. Why is this happening.

eBay's deadline for claims is always 30 days. Payment providers allow 120 days. After that you'd need to use money claim online (used to be small claims court).

If a seller offers a five year guarantee it's entirely up to the buyer whether they can enforce it. eBay has no further interest once its own, 30 day money back guarantee has expired.

It's safer never to rely on warranties supposedly offered on items sold on eBay. Sellers' own warranties are only as good as the seller who gives them; we receive endless questions about sellers who don't want to know about problems. Even manufacturers' warranties are liable to be invalid for items sold here. Few sellers here are authorised distributors and some source their stock from grey imports or trade clearance stock of customer returns or seconds.

Remember that eBay warns buyers in the user agreement that they do not guarantee that items sold here will be truthfully described, safe or even legal. So what value would you place on sellers' claimed warranties?

Was it a business seller if so contact Citizens Advice.

If a private seller no way to enforce and in any case warranties are very rarely transferable.

Has anyone ever challenged that in court, if ebay allow sellers to advertise warranties then ebay are responsible to make sure the seller meets his obligation to said warranty.
Ebay should as a responsible site take steps to either remove all warranties from advertisements on their site or make sure that waranties are enforceable as they make money from each sale so have a shared responsability to the customer. 30 days does not mean a thing if they have allowed a seller to advertise a 5 year warranty

eBay's position on warranties / guarantees that sellers offer is clear. They cannot offer any further protection against items not as described outside their 30 day MBG Money Back Guarantee policy. They do not physically see the items being sold so cannot guarantee their working correctly for 5 years.

If this was purchased from a Private sellers, warranties are usually not transferable and belong to the first purchaser.

If you purchased from a UK business who offered this warranty and is now not honouring it, then it is worth contacting Citizens Advice for any further steps you can take.

As for going to Court, forget that move, you'd lose a lot of money!

Ebay do not have to honor the warranty all they have to do is make sure it is enforced by the seller as they have allowed the seller to advertise such warranty, unless ebay have instructed sellers not to offer warranties they are liable to help enforce the warranties offered.

eBay have always stated that sellers are responsible for whatever they put in their listings, they are not liable.

Any warranty offered by any seller anywhere is only ever going to be as good as your ability to enforce it, something to consider before buying. The only way you'd be able to challenge it would be if you're buying direct from a retailer and can pay with a credit card at their checkout. A direct to seller payment will give you Section 75 cover for years.

Ebay are wrong, for a seller to advertise a warranty then refuse to honor it by ignoring messages, is false advertising something which is covered by our consumer laws already.
Ebay must decide to either force the seller to adhere to the conditions of their advertisement
remove the advertisement or remove the seller from their platform.

Ebay is an advertising site, they don't sell anything.

Ebay MBG is in addition to your consumer rights, but ebay won't get involved with them.

If you bought an item advertised in a newspaper/magazine, you wouldn't go back to them if item was faulty.

Whatever you may feel that eBay "should" do I feel that even in the medium term they are unlikely to change their terms. EBay's listings make it clear that responsibility lies with the seller. Business sellers put a declaration that they will comply with laws.

I am sure that eBay has access to highly professional lawyers who have looked at [and approved] their terms of trading.

Many members threaten to "sue" eBay but I can recall no successes in the press!

Check section 2 of the legal agreement. eBay is simply a sales portal. It is not a party to sales made here and the seller is entirely responsible for any descriptions and claims they make. eBay even warns buyers that they do not guarantee the quality of items, or that these will be truthfully described, safe or even legal.

What shop could get away with stating this - and who would use it if they did? Many users have no idea what conditions they agreed to accept here. eBay is a jungle.

eBay's own involvement is limited to its own money back guarantee. This only lasts for 30 days, and only covers the condition of the on delivery. When this has expired eBay has no interest, whatever happens.

If they are an advertising site all the better, they cannot allow false advertising on their site and must take steps to make sure advertisers fulfill their obligations as outlined in the sellers advertisement I.E. if a seller advertises a 5 year guarantee ebay as the host advertising site must make sure that the seller fulfills this promise to the buyer.
Why has no-one questioned this before its a simple concept really all ebay have to do is send an email telling the seller he must honor his advertisement.
I also thought ebay was classed as an e-commerce site and as such subject to the consumer laws of the countries it operates in.

Should really depend on what you are suing for, money ebay will fight tooth and nail, to get sellers to fulfil their obligations that they have quite clearly advertised on ebays site, should not be too difficult.
Ebay has a responsibility to both seller and buyer that the terms and conditions of any contract must be met.
But this leads to another question that undermines this whole site why cant ebay force a seller to meet his terms and conditions they are what the seller advertised.
Money is not everything in this world in fact its pretty useless, if a business like ebay cannot be trusted to make sure sellers honor the contract between buyer and seller then the site is undermined and nothing more than a cash grab fleecing the hard earned money of the buyer and giving no recourse to action on the buyers behalf.
60% of any business is reputation no reputation no business.
That a seller can renege on a guarantee impacts on the site directly so quite simply do not allow any guarantees at all or make the sellers honor the guarantees given.
