Question Cheating seller covered by eBay in Member To Member Support DO NOT DELETE

Every seller knows how restrictive eBay policies are.

So I bought an oscilloscope for £52.39

on 20/08, 3 weeks ago. Marked as dispatched on the same day. Free shipping from China. A few days later I received a message from seller saying these oscilloscopes have fault and he has to send them back to manufacturer (lie, already marked as dispatched few days earlier). Ok, I asked when he is expecting to have more, as I already ordered a probes and adaptors for this particular oscilloscope for a total of about £15, I sent him links to listings where I bought them. I waited for a reply for a few days. After more than week from purchase (and despatch) date he said that he has these oscilloscopes in China, and if I want one, I have to pay additional £12 for shipping. I replied asking him if he's joking. Another few days later he begged me to not open a case with eBay, nor leaving a bad feedback as he was sick or so, lies, lies, lies... I said that I want my money back, I repeated this request a few times. Yesterday I finally received the refund. So now, I want to warn other buyers from this cheater. Obviously I can't leave the feedback now, as the expected delivery date is far away in the future, and I have to wait 7 days from the expected arrive date to leave negative feedback, which is so ridiculous that I usually forget about the whole case. But this time it's even worse. The seller cancelled the order and I can't leave the feedback at all! I tried contacting eBay, but after clicking through several pages I got to the right place, and saw the message:

"We're sorry, there's an issue with this purchase. Unfortunately, PayPal reports that we can't open a case for this item. You can try to sort out this problem by contacting the seller."

So shall I kindly ask the seller "Could you please "uncancel" the order so I can leave you negative feedback to protect buyers from you"?

Is that the way eBay protect the buyers?

Edit:

pity there's no option to reply.

redwick1:

no, he didn't received ANY defect on his account because:

1. he marked the item as despatched, with delivery date on about 20-30/09

2. I could not open ANY case as the expected delivery date is in the FUTURE

023mjc:

exactly, I should be able to leave the feedback, but I'm not, as he cancelled the order (holding my £52 for 3 weeks).

If I only knew it's possible, I wouldn't have any negative feedback, although I always refund if the buyer is not satisfied, they don't remove negative feedbacks.
