Question passing off? trading name in Member To Member Support DO NOT DELETE

Hello,

I recently purchased a small tool from a company

I assumed incorrectly that it was a uk company ... clicked the paypal button an ordered the part. A couple of days later I realised delivery was quoted as about 5 weeks and the company was based in china (yes - I should have checked the source address)

I contacted them and told them to canel the order but it was too late. I had to purchase the same thing elsewhere and now need to return the part. They have given me an address in China...so i have to pay the return postage there and hope I might get my money back.

My question is .... under English law of "passing off" is it deceptive to call the company xxxxxx_UK when clearly it has nothing to do with the UK? ..or does it contravene any eBay policy?

thanks awba3
