Hi I have an unpaid case open but note that this buyer has done this frequently as sellers have left warnings on the feedback, albeit showing a good feedback mark! Its crazy that we can't leave negative feedback for buyers who just ignore seller and even the case that is opened against them. EBay says they put a mark on their account to show an unpaid item but is that all that happens? They can just go on abusing the system this way?

You have answered your own question here as to why this buyer is allowed to carry on buying and not paying. By seeing false positives on the buyers account ( all policy violations by the way, and the seller's will receive strikes on their account), these sellers have not opened unpaid item cases, so Ebay do not know this person is a constant non payer. No one in Ebay Towers sits and reads feedback.

If all these people had opened an unpaid item case against them they would have received their 2 or more strikes, and if you have your preferences set correctly they would not have been able to buy from you. My buyer activity log shows I have blocked 3 non payers this month! Consistent unpaid cases, and yes this is flagged up and then Ebay will suspend the buyer.

If these other sellers had done as you are doing, and opened unpaid item cases, this buyer wouldn't be able to carry on doing this. Most sellers exercise the option to block bids from buyers with two or more unpaid item strikes.

In fact, not paying is the one situation where sellers CAN take effective action against buyers. Where not being able to leave feedback becomes an issue is when the buyer is abusive or dishonest, and there's no way to warn other sellers about this.
