    <description>&lt;P&gt;Recently bought a used nail gun for a proposed home shed build - listed as 'good working order'. Arrived no problem but when I came to use it it wouldnt fire at all. I took it to a local repair place and they said it needed a new 'driver' which was a part no longer available. So&amp;nbsp; requested a return, as it was defective, under the ebay money back guarantee, even though the seller stated didnt give refunds I believe I am covered(?)Next day the return is closed, no clarification received, and seems I have no right of appeal.&amp;nbsp; How can I now pursue this?&lt;/P&gt;</description>

&lt;P&gt;A return request and a money back guarantee case are completely different. Which did you open?&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;My guess is that it was an ordonary return request, which the seller was entitled to refuse if they don't accept returns. The seller could not close a money back guarantee case, which as its&amp;nbsp; name implies, would have guaranteed you a refund. If necessary, eBay would have enforced it.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;You can't open another case through eBay now. If you paid by PayPal, file a dispute under their 180 day buyer protection policy.&lt;/P&gt;</description>
