Fake item received, seller says I have to pay for return but will not give refund.

Nope the seller is wrong.

You open a case for item not as described in the Resolution Centre, link at foot of most pages, and if the seller wants their item back, the case enforces them to pay for that fully tracked return postage.

Just a tip, if bought from a Chinese seller whose item location on the listing states UK, then don't be fobbed off that the item needs to be sent back to China, it doesn't, it gets sent back to wherever the item location stated on the listing ..... and here..... at the seller's expense.

The seller has stated cannot provide returns label and will not refund because I opened the item, it was foundation makeup and clearly fske once opened, obviously don't want to spend more money returning if I'm not going to get refund, paid by paypal

Ignore seller. Follow eBay case rules.

The fact they sent you a fake (Not as described), proves to me they can't be trusted & might say anything.

Follow the advice of @tressygirl

Ignore the seller. Open a case for "not as described" [and ignore the seller]. The seller must send a label and if he does not then after 9 days escalate the case to eBay. At that time the seller will find the error of his ways as eBay will refund and take the money from the seller.

The seller is possibly thinking of legal rights for sale of goods where - indeed - there may be no requirement to refund opened make up. EBay is better!

I don't know how to escalate to ebay the seller refuses to send a label for return postage I have waited the 9 days when I click on purchases it just says you started a return for this item.ans asks me yo send yo sellet

Find your case in the resolution center, you escalate it there.
