    <description>&lt;P&gt;Hi all, we have recently sold and sent an item that was automatically&amp;nbsp;added to the ebay GSP, its destination was Israel not that we were bothered at all it is ebay's&amp;nbsp;job to get it there&amp;nbsp;all we do is send to the UK address.&lt;/P&gt;&lt;P&gt;&amp;nbsp;One month or so after it had been posted we received a complaint message from the purchaser saying it had arrived but had then&amp;nbsp;been stolen? stolen from the collection office in Israel, signed for by the bloke but then stolen? ok not our problem ebay sent it to you so we must be covered, plus if it is stolen from him after receiving it then how can we be to blame?? well we can.&lt;/P&gt;&lt;P&gt;eBay took control of the dispute abd would not allow us to get involved, the case was closed by ebay with them sorting it, or so they said but a case then opened a month after that on paypal by the purchaser, so if he had not only had the item stolen from his person, he received a refund we thought&amp;nbsp;from ebay, now paypal wanted to join in, we told them what had happened and that ebay had sorted the dispute out the previous month, but the case closed without warning handing the purchaser yet another refund, so work that one out!&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;What would you do in this situation we have been slapped more times than a morris dancer with this one.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;What Case did they open with PayPal? If it was for Item Not As Described, Faulty etc. You would have to Refund. PayPal wouldn't be aware that the Buyer would have been claiming from Ebay for a Stolen Item.&lt;/P&gt;</description>

&lt;P&gt;What kind of case did they open with PayPal?&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Once you have answered these two questions then full advice can be given, especially&amp;nbsp;as it was sent via Global.&lt;/P&gt;</description>

      <description>eBay took over and they refunded him on the 29th of October, they then opened an item not received case on the 10th of November with Paypal, we told them everything and copied the eBay messages proving they had refunded.</description>

      <description>All we had to do was get it to the ebay address in the UK, the tracking proved that, eBay's tracking proved it has also arrived in Israel, it was as he left the building the item/ package was stolen, you could not make it up, he has an item stolen in what I would call a mugging from his person and he blames people in the UK for him not slapping the bloke who robbed him in his own country. its a total joke.</description>

      <description>Did you put the tracking to the hub on paypal when they opened the dispute.&lt;BR /&gt;&lt;BR /&gt;As long as you showed delivered to the hub then you should have won.&lt;BR /&gt;</description>

      <description>Yes, I put both our tracking on there straight away saying this is crazy he has not only had a refund from ebay here is the proof I honoured my part of the deal and got it to ebay, and here is the tracking from ebay as well to show he received it in Israel,</description>

      <description>&lt;P&gt;I cant see if you put the tracking on proving dleivered to the hub why paypal refunded.&lt;BR /&gt;&lt;BR /&gt;Get on to the phone to them and complain if you have not already done that.&lt;BR /&gt;&lt;BR /&gt;They are usually better than ebay to deal with.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;I believe they are under the financial services so have to deal with complaints unlike ebay.&lt;/P&gt;
&lt;P&gt;Unless they give a proper explanation of why they refunded I would push this one in writting if neccasary&lt;/P&gt;
&lt;P&gt;If you dont get anywhere then contact Citizens advice and ask them&lt;/P&gt;

      <description>&lt;P&gt;eBay's and PayPal's hands are tied communication wise now thanks to the new data protection regulations.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;It has made this sort of double dipping possible because eBay can't tell PayPal that they've issued an MBG payment in relation to this transaction.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;It's very difficult to sort out. It needs PayPal to treat the refund they issued the buyer as a processing error and credit your account with the amount they've refunded. To get them to do that, you'll have to speak to a human being and explain the buyer has double dipped (use that term).&lt;/P&gt;
&lt;P&gt;&lt;BR /&gt;Be firm but insistent with them - use the terms processing error and double dipping as often as you can during the phone call.&lt;/P&gt;</description>

      <description>&lt;P&gt;Technically, the first case is irrelevant. You were not involved, as it was correctly taken over by eBay as a GSP issue. So don't make too much out of the "second refund" argument.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Your complaint against PayPal is that the buyer's case was found against you - assuming that the refund was taken from your account, and not charged to eBay.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;If so, PayPal has a proper complaints procedure, and you can in the last resort refer complaints to the financial ombudsman. PP's user agreement explains both procedures. It seems to me that there are two issues, either one of which would justify an appeal.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;The first is that the item was sold under the terms of eBay's GSP, which both you and the buyer accepted in the user agreement. You correctly discharged your own duty under the user agreement by posting it with tracking proof of delivery to Pitney Bownes, eBay's reshipping agents.&lt;EM&gt; That is all the buyer's PayPal payment to you covered, not delivery to Israel.&lt;/EM&gt; EBay invoiced the buyer direct for the international shipping. They, and not you, are liable for any claim relating to the international delivery.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;The second issue, although this is less clear as we don't know exactly what happened, is that anyone can sign for parcel, it doesn't have to be the buyer. Once an item is collected and signed for the seller is not responsible for what happens to it afterwards. But, returning to point one, if anyone is liable in this instance it is eBay and Pitney Bownes, not you.&lt;/P&gt;</description>

      <description>Yes I will, nothing left unsaid it is as cut and dry as that, he lost the item, ebay buckled and paid him out due to what ever reason they found out, I was not a party in that investigation, ebay update paypal with the tracking numbers automatically still, but I added every tracking number I had and told paypal our side instantly saying its all refunded and this is beginning to look like a scam, and that was it, the case was closed in the end and the bloke received the money back from our paypal, a total joke.&lt;BR /&gt;&lt;BR /&gt;I am waiting for a message reply from Paypal on the new chat system so lets see what bonkers reason they come back with this time.</description>

      <description>I would not be waiting for a reply from chat.&lt;BR /&gt;&lt;BR /&gt;Phone them. It is not hard to do and they are usually quite good to deal with.&lt;BR /&gt;If they dont give a reasonable reply then keep on complaining.</description>
