i win the bid but noticed that it had been used for a taxi but the owner wont lete it go and insists i pay the bid .constant mesages

WAs it on the listing or was it through checks you made after buying?.

If it was not on the listing then the seller should agree to cancel but they will pay the inserton fees

If it was on the listing

You should have read the listing properly if that information was on the listing.

If you won and do not pay then the seller can open a non payment dispute and once that closes you get a non payment strike on your account

One will not harm but two or more and you would be not be able to bid on many sellers items

By buying and then not wanting to pay it has wrecked the sellers listing and cost them money

They have to pay the insertion fees which is not free for motors and also any upgrades to the listing

I dare say the seller is rather upset about it

When you buy a motor vehicle there is no buyer protection so you need to go and inspect the vehicle thoroughly first, and only hand over the cash when you are absolutely sure it is exactly what you wanted.

If you inspect the vehicle and find it doesn't meet up with the description you can ask the seller to cancel the transaction with no hard feelings.

Always pay cash, or bank transfer once you have inspected it. Do not pay via Paypal

A seller can't force you to pay full stop.

A seller who hasn't told you that the item was a former PSV in the advert hasn't got a leg to stand on when it comes to taking you to court.

I wouldn't even tolerate a non paying bidder strike here - I'd be on the phone to eBay and getting the non payment strike removed the moment I received it.

As far as the seller is concerned, tell him, on the advice of trading standards, you've decided not to proceed with the purchase of a taxi that was wrongly described as a domestic vehicle.

Send them the phone number of your local trading standards office and suggest they take the argument up with them if they'd prefer to try and force the issue.

You won't hear from them again.

The seller can't make you pay, especially if the van wasn't as described.

The best thing for both of you would be for the seller to send you a cancellation request.

If they won't do this, they will probably open an unpaid item case to get their selling fee returned. If so, you will receive a non-payment strike on your account.

If this happens, phone eBay customer support and appeal the strike. If you read the user agreement, you will see that bids for vehicles are not a commitment to buy anyway, only an expression of interest in buying the vehicle. I don't see how eBay can give you a strike for not paying when you were not obligated to buy anyway.
