"I have lost on the return postage." WHY?

It sounds as though you have never read the money back guarantee!! You open a NOT AS DESCRIBED CASE, seller has to supply a reply paid Return Label, and on return you geta FULL refund. If seller dosn't deal with it, then after 8 days you escalate to ebay, who take over. They supply the return label at seller's expense and again on return you get a refund.

Seller gets a Defect and still has to pay the selling fee.

How can you lose anything, it is the seller who loses by paying a selling fee and the postage to you and the return postage.

I'm not entirely clear what point you're making?

You've given two examples of receiving allegedly not as described items. But if you use eBay's money back guarantee correctly, you should not lose out on the return postage. Provided the item was located in the UK, eBay requires the seller to provide a prepaid return label.

Sadly, there are some cowboy sellers around, but as you say eBay gives buyers pretty good protection in most cases.

If anyone is poorly protected it's sellers, because there are plenty of cowboy buyers around too! But this doesn't seem to be the point of your question.
