guarantee policy

Hello,

 

I have bought a tablet in May this year. After a couple of weeks of use the screen was broken. I sent a request for a guarantee. The seller accepted the tablet and advise that it will take up to 8 weeks. I was waiting for the item after 8 weeks I send an email and then the seller advised again it will take a time to get it back. Finally I send another email after 10 weeks and this time I did not get any feedback. My assumption is that I lost the tablet and money.

 

How eBay can help me? should I report a stolen item to police?
