If all else fails you could try "Chargeback" apparently its not just Credit cards that give you this cover.
I dont know whether its best to let Ebay/paypal try and resolve first..
I wouldnt post anything back yet.. Ebay will give you their address..

I would let the Ebay/Paypal proccess go first..
After reading that link it looks like you have upto 120 days to apply for a chargeback.
Unfortunatly if it was a Debit card that finances Paypal then that only covers upto £100 and also going via PayPal might throw a spanner in the works as the card company may say that they DONT cover the transfer from your Paypal account to the sellers Paypal account BUT if your paypal account was empty then money is transfered directly from your bank to the sellers PayPal account, which might be covered?.
Either way it`ll be a few weeks I would think..
All the best..Let us know what happens..

When you escalate ebay will give you his return address
Don't send it anywhere but that address
If you are unsure of what to do at ANY stage of this please come back and ask.

As an unfortunate viewer of frequently brain numbing daytime TV, these Photo but not Item scams have hit the Courts on USA TV and are well known, and needless to say, deeply frowned upon for the scams that they are.
I don't think you are likely to have a problem with your Claim, be it via eBay or PayPal.
Hopefully your experience will be resolved very quickly.
I know it's pointless for me to tell you not to worry, you're only human (like the rest of us! ).

Out of interest, what made you buy it from that listing anyway, as opposed to on the High Street, or an online retailer of more renown?

I know its misleading and the seller is a con artist BUT..it says PHOTO in the title and I wonder if you can actually say its a SNAD?

They listed it in 'Games Consoles', and listed all the technical specs......
It has got me thinking, if it was listed under 'Photographs' [or whatever] and didn't have all the technical specs, and someone still fell for it....would they win a SNAD in that case?
