someone wanting to returning an item is being unfair and has opened my 1st case against me, please help.

Hi, looking for any help or information please.

I recently sold a brand new without tags topman jumper.

I closely inspect every item before listing and write in-depth descriptions on my items.

I was horrified when the buyer suggested that the item was infact used and wanted to return it.

The item was an unused xmas present from last year and didnt even fit so there was absolutly no doubt that it was new.

The buyer claims the label has fallen off on one side.

I agreed to a refund but the buyer has now opened a case against me and has demanded i refund them including extra to send the item back or i'll have a case marked on my record.

I am concerned that this will effect my account as i dont even have any negative feedback.

Please help

Hi

All you have to do is agree to the refund once they have sent the item back.  That should stop any black mark on your account

The buyer is responsible for sending the item back via tracked means at their own expense for a full refund of the original costs

A good seller would refund the return costs on receipt of the item if at fault, but you are not obliged to do so

NO Return = NO refund

It is out of your hands now that they have opened a dispute.

ebay will instruct them to send the item back at their expense by a tracked postal service.

Don't refund until you have it back and in the same condition that you sent it in.

Refund if you are happy.

To get your fvf back you will have to issue a Transaction Cancellation Request. via the Resolution centre.

see here:

http://res.ebay.co.uk/ws/eBayISAPI.dll?ResolutionCenter&hc=1&hm=vo%7B2d71f%2B2noa%7Djh%7Ecr1

Your buyer will have to agree to the cancellation and if they do, you will recove you fvf from eBay.

Probably means they don't like it, or it doesn't fit.

To open a dispute they have to have a reson why it is not as described so they may have made one up.

You are not obliged to refund any return postage. You certainly shouldn't pay it to them up front or refund until they have returned the jumper.

You are caught between a rock and a hard place.

If you resolve he dispute within 3 days of opening then it should not be marked on your account. From what you say this would mean refunding them in full and saying goodbye to your jumper.

If you wait until they escalate the dispute then it will be marked on your account. There is also quite a good chance that ebay may do a courtesy refund. this means they keep the item and get a refund (from ebay, not you). You get to keep their original payment.

I fear you could be on the receiving end of negative feedback and trashed star ratings. This won't help your seller account at all as you have only just started out. Your buyer has a lot of feedback and may well know how to play the system.

If they have made this threat via the ebay message system then you could telephone ebay and ask their advice/report the buyer. They may be wll known to ebay if they make a habit of this.

If they have been sneaky and used your private email from the paypal transaction then you have no proof to show ebay.

Well the bad news is that our buyer has already left negative feedback.

The good news is that as they've mentioned the case you have grounds for having it removed. Enter "feedback removal" in the customer support / keyword field for how to do this.

My advice would be to offer to accept returns as if you don't buyers will invent any reason to make buyer complaints.

It is impossible to cancel a payment once it has completed.

Sounds as if either ebay/paypal has refunded it or a chargeback has been done.

Please contact ebay.

Once you start getting into the details of a specific case only they have the info and can advise.
