I sold an item.  Buyer wanted to collect.  I was ok with this.  After 2 failed collections, buyer paid and I posted.  Buyer left me positive feedback.  I have just been searching through ebay, and seen my picture, and seen this was the buyer who bought from me, selling the item on, which is ok, but using my picture.  I contacted and advised on copyright.  they have contacted and advised they have now just inflated the item, and see it is faulty.  They are wanting a refund,  I have refused, as item was in full working order when I posted.  They have just messaged and said, they will drop off at my home address( they have this as was going to collect ).  Were do i stand as a seller, as dont feel i have done nothing wrong.

Unless you agree to a refund then they would have to open a dispute.

 

This would require them to return the item to you using an online trackable method - at their own expense.

 

You should have just reported the listing for using your photo. As you have found out it, has somewhat backfired when you challenged them.

 

Now they say the item is faulty you will have no choice but to accept it back. It is better to do that without a dispute being opened.

 

Although you seem to have forgotten to register as a business seller, you clearly are one. Items have to be fit for purpose.

 

Refunds must always be done via the original paypal transaction.

strangely enough, the buyer has now listed the item  in 2 separate lisitngs, 1 for 24 hrs, and 1 for 3 days.  Obviously nothing wrong with item, must have another one to sell......... just didn't like me contacting them, about using my picture....in future will just go straight for reporting, but have done this before, and ebay not been quick to act.
