The phone was in perfect working condition, i gave it the once over before I sold it. However seems a bit dodgy that a brand new phone could suddenly go 2 weeks after I sold it.

 

I'm currently jobless and said money for mobile phone has gone on paying bills so im in a no win situation if I return the phone as I don't have the cash to refund the item.

 

Any advice would be great.

if you don't accept back they will file a dispute and you will be forced to refund

 

if you don't ebay will refund and help themself from your selected method of reimbursement

 

ou need to ask them to return at their expense using online tracking before a full refund of original payment

 

a good seller will fund return if at fault

Firstly I hope you have a note or picture of IMEI number of the phone to make sure they haven't swapped it for another.

If you have and they do send a different one you can appeal.

 

Onto the bad bit, if they open a case, they send the phone back to you at their cost with tracked postage to prove it arrived with you. If they do this and either the phone is the one you sent out or you can't prove either way, a refund will be forced from your paypal. Your paypal will go into minus figures and it will be them chasing you to bring the balance back to zero or more - you'll have some time to do this but unfortunately the refund can't really be blocked.

 

Of course you could always defend that the phone is not in the condition sent out. If you're lucky ebay will give them a refund out of their own pockets and you're ok then.

No i didn't think of taking down the IMEA number, so i may be screwed then and 200 pound out of pocket.

the same rights as any private seller

 

the right within the sale of goods act to only accept a return on valid demonstrable grounds

 

and no extended libailty to how the goods function

This is ebay - not the real world.

 

Sellers have to abide ebay/paypal rules and not be mislead by legal mumbo jumbo with no truth in the rules of ebay land.

Ok slight update on this, got the phone back this morning. checked the box and for some reason the headphones that were dispatched with the phone are missing and a different replacement has been put in the box.

 

also of note yes its the same phone as the pin number matches my registration on the blackberry website.

 

HOWEVER. I checked the litmus paper where the battery sits at the bottom of the phone. It has now turned red which means it has been exposed to water. therefore since the ebayer got it, gave me feedback it was working fine and then messaged me about saying the screen was flickering and suddenly went off and it being returned to me the phone has suffered water damage, therefore its the reason why it's not working.

 

Theres no way I can refund this seeing as it was working for the customer and then it gets returned with water damage?!?!

Also note there appears to be staining there aswell perhaps from water damage?!
