How can I cancel a transaction if the buyer won't respond?

I advertised my van both on ebay and elsewhere. Someone called from elsewhere and gave me a deposit for it in lieu of collecting it on Tuesday. 

Then a member from eBay called to ask about the van. I said it has been sold but if the other seller changes his mind I'd let him know. He then said "can't I just click on buy it now"? I said no, it's not available. Then he did it anyway, within minutes of the call. 

He's ignoring my messages about cancelling the transaction and insisting on sending a deposit!

I only kept the listing up in case the other buyer changed his mind so I wouldn't have to pay again for listing on eBay (I've dealt with so many time wasters in the last few weeks) and now he's acting as if I never said it had been sold in the first place. 

What can I do? He keeps sending messages asking about how he can pay the deposit and collect!!

Problem is, ebay consider this transaction to be binding, and you can be reported for Seller Non-Performance and get negative feedback and trashed DSRs if you don't go ahead.

 

You will also lose ebay final value fees on this if your buyer isn't agreeable to a cancellation.

 

It really wasn't a good move to leave a live listing up if you considered the item to be unavailable.

 

It's your call, you can either refund the other guy's deposit and honour the ebay deal, or take the hit.

you are not allowed to list it elsewhere when listing on ebay. Why would he want to send a deposit on a van he has not seen is beyond me. Stand by for feedback you do not want and seller non performance.

You did an "off eBay" deal that is not allowed and can be reported as Fee Circumvention as well as Non Performing Seller.

 

Why would you not refund a deposit if the winner chose not to buy after he had seen it? That could be construed as theft or obtaining money by false pretences.

 

I'm sure it will earn you a well deserved Neg feedback.

 

That negative comment on Positve feedback you left for a buyer  on 29th Sept is also a policy violation and can be removed, earning you yet another strike on your account.

Have you not read the eBay agreement?

 

Next time use eBay classified, it's much easier, and more simple.
