Hi i sold a dress sept 13 and the buyer left me a postive feedback on sept 22 that its a gorgeous dress and she want lots more, then she emailed me me the same day how she love the dress and will i do a deal if she buy two more colours but she never did buy more. then october 25 she emailed me that she bought the dress for the wedding that will be in 4 weeks and she tried the dress on and lots of people noticed loosing thread and poorly stitched zip and she wants to return, i am an honest seller so i replied right away i will give her a full refund and will shoulder the return postage as well coz the item is faulty, my mistake coz i didnt checked the date of the purchased. I received the dress yesterday and there is ripped in the sticthing near the zip but was gonna refund her when i just notced she bought the dress sept 13 and even left me postive feedback sept 22. She said she will not leave me negative feedback if i will give her full refund. I just dont think its right to still refund her coz its been almost 2 months since she purchase the item. 

 

If ever i wont give her a refund will she still be able to file a case against me or will she still be able to leave me a postive feedback since she left me postive feedback already? Thank you so much.

 

 

Ive been a top rated seller for a year but its just recently i keep getting nasty customers, will ask for refund and i refund them and dont send item back. i know i shouldnt refund if i wont receive item back but i always bend over backward to make buyer happy to maintain a good feedback, but its just not right anymore. I dont care anymore if i wont be top rated seller anymore.

She should have checked the dress properly before leaving her original feedback, which by the way she cannot change to negative.  I would imagine she has worn the dress already for the wedding or whatever and now has no further use for it.  It happens a lot with clothing.

 

Tell her no refund.  It is too late, she won't get anything from paypal and ask for postage to return it to her.

 

I think a lot of sellers are getting threatened with negative feedback since Ebay changed the rules.  I had someone threaten me with negative once - I told him to go ahead, I won't lose any sleep over it.

It is now more than 45 days since she bought the item so it is too late for her to open a case. It is not too late for her to leave feedback (60 days) but as she has already done that I think the most she can do is leave follow up feedback to the positive she has already left. She can't change a positive to a negative.

 

When you mention the rip in the stitching do you mean that you think she has ripped it while wearing it - or is it possible it was ripped when you sent it?

Hi,

 

They are too late to open a dispute as the time limit is 45 days from making payment.  They can't change their positive feedback to a neg, but they can add a follow-up comment.

 

As a Business seller I don't think you have any option but to refund under Sale of Goods Act and/or distance selling regulations.  However, you can try asking on the Business selling board:

Also suggest that you revise your Returns Policy so that it complies with Distance Selling Regulations. A buyer needs to be refunded in full i.e. including original postage even if it's change of mind.  If you state that buyer pays cost to return for change of mind then that's fine.  If item is damaged/not as described you should reimburse cost to return.

I always checked items if its faulty before packing and posting them but i know sometimes i can still make mistakes, but there is no way i wont see the ripped of the stitching, so i am sure it wasnt rippe when i send it to her. I dont know if she ripped it while trying it on or what but my question is am i still oblige to give her a full refund even it the purchased is made after 45 days?

you do not have to refund after the 45 days but she may do a hargeback through paypal so keep your pop incase.
